Go Generic - Terms of Use

Introduction

The domain name www.gogenericpharma.com, an internet-based portal, and the Go Generic mobile application (collectively referred to as the "Platform") are operated by Singhania Med Private Limited, a company duly incorporated under the provisions of the Companies Act, 2013 (hereinafter referred to as "Go Generic" or "We" or "Our" or "Us" or "Company"), having its registered office at 4A, Kanchan Villa, Kanke Road, Ranchi, Jharkhand – 834008, with GSTIN [Insert GST Number] and PAN [Insert PAN Number].

Your access to or use of the Platform, transactions on the Platform, and use of the Services (as defined herein below) hosted or managed remotely through the Platform are governed by these Terms of Use, including applicable policies which are incorporated herein by way of reference.

By accessing, browsing, registering on, or transacting through the Platform, or availing any Services, you signify your agreement to be bound by these Terms of Use. You also agree to our Privacy Policy, Refund Policy, and other applicable rules and policies.

1. Services Provided

The Platform facilitates:

  1. Online purchase of pharmaceutical products (including generic medicines) from verified third-party pharmacies ("Third-Party Pharmacies") and the Company.
  2. Delivery services through our in-house delivery team or third-party delivery partners ("Delivery Partners").
  3. Healthcare-related information to help Users make informed health choices.
  4. Promotional offers, loyalty programs, and referral rewards from the Company or partners.

Third-Party Pharmacies, Delivery Partners, and other collaborators are collectively referred to as "Third-Party Service Providers". The sale of products by the Company, services by Third-Party Service Providers, and health information are collectively referred to as "Services".

2. Role of Go Generic

The Platform is an intermediary, providing a technology interface for Users and Third-Party Service Providers to connect and transact. Go Generic is not the manufacturer of all products sold and is not a substitute for professional medical advice.

3. Eligibility

You must be:

  • 18 years or older
  • Legally competent to contract under the Indian Contract Act, 1872

Minors may use the Platform only through a parent/guardian account.

4. User Registration

To access certain Services, you must:

  • Create an account with accurate details
  • Maintain confidentiality of login credentials
  • Notify us immediately of unauthorized use

5. Ordering & Payment

  • Orders can be placed via the Platform subject to product availability.
  • Payments can be made via UPI, Net Banking, Debit/Credit Cards, or Cash on Delivery (COD).
  • Prices are inclusive of GST unless stated otherwise.

6. Delivery

  • Deliveries are handled by our Delivery Partners or third parties.
  • Estimated delivery times are indicative; delays may occur due to logistical or regulatory reasons.
  • Risk and title of products pass to you upon delivery.

7. Cancellations & Refunds

  • Orders can be cancelled before dispatch via your account dashboard or customer support.
  • Refunds will be processed as per our Refund Policy.
  • Certain products (e.g., temperature-sensitive medicines) are non-returnable except in cases of damage or wrong delivery.

8. User Obligations

By using our Platform, you agree:

  • Not to misuse or resell products purchased.
  • To provide prescriptions for prescription-based medicines when required.
  • Not to engage in fraudulent transactions.

9. Content & Intellectual Property

All content, including text, graphics, logos, and software, is owned by Go Generic or licensed to us. You may not reproduce, modify, or distribute content without prior written consent.

10. Prohibited Activities

You agree not to:

  • Use the Platform for unlawful purposes
  • Interfere with its security features
  • Post misleading or harmful content

11. Third-Party Content

The Platform may contain links or content from third parties. We are not responsible for such content or services.

12. Disclaimers

  • The Platform provides information but does not replace medical advice.
  • We do not guarantee uninterrupted service or error-free operation.
  • Product images are for representation only; actual products may vary.

13. Limitation of Liability

To the maximum extent permitted by law:

  • Go Generic will not be liable for indirect, incidental, or consequential damages.
  • Our liability is limited to the value of the order in question.

14. Indemnification

You agree to indemnify and hold harmless Go Generic, its affiliates, and partners against any claims, liabilities, or damages arising from your use of the Platform or violation of these Terms.

15. Governing Law & Dispute Resolution

These Terms are governed by Indian law. Any disputes shall be subject to the exclusive jurisdiction of the courts in Ranchi, Jharkhand.

16. Changes to Terms

We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
